Image Delivery Time

Proofing galleries are typically delivered within 1 week of your session date.

After purchase, final images are guaranteed within 3 weeks from date of purchase via proofing gallery unless a different milestone is communicated by Brittany (example: Brittany is on vacation for extended period of time). No retouching will occur until purchase is placed via gallery.

An expedited image fee is offered for your convenience and can be purchased via your proofing gallery, but you must notify Brittany when placing the order.

All galleries are kept on file for 3 months and, with payment of a $50 re-open fee, clients can re-access their images for additional purchases. If there is a code provided to redeem a digital images package, it will auto-expire at the end of the month which is communicated in the gallery email. If it has been longer than 3 months, additional orders can not be placed.

Final images are kept on file for 1 year as a courtesy in case clients encounter any computer issues which results in loss of their images.

With purchase, Brittany Link Photography releases the right to the client to use, display, print, copy, post, email, publish via the web, and/or distribute the photographs purchased in any form. This release does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature on behalf of the client.

Rights release includes examples where an organization or company wishes to use your images on social media or in print to promote you as an individual or titleholder; release does NOT include organizations or companies using images in any capacity to market products or services. If client/model becomes aware of an organization/company wishing to use images for commercial use, you agree to connect organization/company to Brittany Link Photography to discuss commercial payments and contracts.

Social Media Use: Digital images, once purchased, edited and downloaded from proofing website, are allowed to be shared and/or uploaded on social media for personal use. Images may not be altered in any way (no filters) 

Print Rights Release

COVID 19 Waiver

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. 
I further acknowledge that Brittany Link Photography has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.
I further acknowledge that Brittany Link Photography can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, photography studio staff, and other studio clients and their families.

I voluntarily seek services provided by Brittany Link Photography and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending my appointment.

I attest that:
* I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
* I have not traveled internationally within the last 14 days or to a highly impacted area within the United States of America in the last 14 days.
* I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19. 
* I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities.
* I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
I hereby release and agree to hold Brittany Link Photography harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the salon, or that may otherwise arise in any way in connection with any services received from Brittany Link Photography. I understand that this release discharges Brittany Link Photography from any liability or claim that I, my heirs, or any personal representatives may have against the studio with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Brittany Link Photography. This liability waiver and release extends to the studio together with all owners, partners, employees, and 3rd party contractors.

Payment & Contracts

Payment: The session fee is due upon booking and is non-refundable unless it meets the reschedule policy below. Deposits are non-refundable.

Any legal complications or stipulations to using pageant titleholder or organization information, official pageant titles, pageant titleholder first name, images, or likeness must be documented and communicated to Brittany Link Photography 2 weeks prior to session date. Failure to do so releases Brittany Link Photography of any agreement for partnerships or sponsorship contracts. 

Model Release

Client Consent: You hereby grant to Brittany Link Photography the right to use and publish images and photographs taken at the session to further promote its service, including, but not limited to: portfolio, web site, display, advertisement, merchandising, product and editorial use, unless otherwise discussed and documented beforehand. Brittany Link Photography retains all copyrights to the images and derivative works thereof.

Copyright

Copyrights and Trademarks: All materials appearing on a proofing website for Brittany Link Photography are the property of Brittany Link Photography. Unpurchased images may be used for shopping, placing orders on this site or for conducting other tasks associated directly with, and for the sole purpose of, shopping or placing an order through this website.

Unauthorized use of the materials appearing on the proofing website for Brittany Link Photography may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties. Such unauthorized use includes, but is not exclusive to, copying, reproducing, republishing, modifying, uploading, transmitting, or distributing any of such materials without the prior written consent of Brittany Link Photography.

Reschedule, Cancellation & Refund Policy

Reschedule and Cancellation Policy: In the case of a session needing to be rescheduled, the client must alert Brittany Link Photography of the need to reschedule at least 1 week in advance to avoid loss of the nonrefundable session fee. Rescheduling after appropriate notice it is at the sole discretion of Brittany Link Photography to agree to a new session date but, if no date can be agreed upon after reasonable attempt, the session fee will be reimbursed. 
If the reschedule notice is less than 1 week away from session date, the request is processed as a cancellation and the client will not be refunded the session fee.

Session and Order Acceptance Policy Brittany Link Photography reserves the right to reschedule, postpone, or cancel client session with four hours notice. If cancellation on behalf of Brittany Link Photography does occur, client is subject to a refund of session fee payment. Brittany Link Photography reserves the right to cancel any order deemed necessary, at our sole discretion, regardless of the order status or whether you have received a confirmation of the order. We reserve the right to require additional information from you and your affiliated organization prior to and after session date.

Return and Re-order Policy: Unless otherwise noted, because of the custom nature of the transaction, and the prevalence of illegal reproduction facilities, products sold by Brittany Link Photography are non-refundable. 

Replacement items for damage in shipping or misidentified images will be honored within a 10 day return policy if the following conditions are met: All products must be returned complete without any intentional damage and all fees for return (shipping and other return shipping fees) are non-refundable. 

Purchase of the original files releases Brittany Link Photography from any liability due to loss or damage of all the images in the client session, and also releases Brittany Link Photography from any obligation to maintain copies of any digital file, image, or photograph.

Privacy Policy

We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.

We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. to ship an order.

Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.
